Terms of Service

These terms are the agreement between you and Light Catchers. By creating an account or using the service, you accept them. If you do not agree, please do not use Light Catchers.

1. Eligibility and location

Light Catchers is offered only to users located in the United States. We do not operate under the GDPR, the UK GDPR, or other non-US data protection regimes, and we make no representation that the service complies with them. By using Light Catchers you represent that you are located in the United States. If you are outside the United States, you are not permitted to use the service.

Accounts are intended for users aged 13 and over. Schools and teachers using the platform with students under 13 are responsible for obtaining any parental consent required by law and by their own policies.

2. Your account

You are responsible for your account: for keeping your password secure, for everything that happens under your account, and for the accuracy of the information you give us. Tell us promptly if you believe your account has been compromised.

3. Acceptable use

You agree not to use Light Catchers to upload, post, or transmit any of the following:

  • Pornographic, sexually explicit, or sexually suggestive content. This is a platform used by students in classrooms. There is no tolerance for this whatsoever.
  • Any content that sexualizes or exploits minors. This is illegal, and we will report it to law enforcement and to the National Center for Missing & Exploited Children.
  • Illegal content, or content that promotes or facilitates illegal activity.
  • Violent, graphic, or gratuitously disturbing imagery, and content promoting self-harm.
  • Harassment, bullying, threats, or hate speech, including content that demeans people on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, or sexual orientation.
  • Content that infringes someone else's rights — photographs you did not take, copyrighted material you do not have permission to use, or images of people who have not consented to being photographed and published.
  • Private information about other people without their permission.
  • Spam, advertising, malware, or attempts to phish other users.

You also agree not to misuse the platform itself: no attempting to breach or probe our security, no accessing accounts or groups you have not been invited to, no automated scraping or bulk downloading of other users' photos, no reverse engineering, and no interfering with the service's operation for others.

4. Your content

You keep ownership of the photos you upload. We do not claim your copyright.

You grant us a non-exclusive, worldwide, royalty-free licence to store, reproduce, and display your content for the purpose of operating the service — showing it to your group, and showing it in the public gallery if and only if you have marked it public. This licence exists so that we can run the platform, and it ends when you delete the content or your account, subject to the backup and caching realities described in our Privacy Policy.

You represent that you have the right to upload what you upload, and that doing so does not violate anyone else's rights.

5. Moderation and termination

We may remove content, suspend accounts, or terminate access at our discretion, with or without notice, particularly where we believe these terms have been broken. Teachers also have moderation tools within their own groups. We are under no obligation to monitor content, and our automated content checks are imperfect — they will miss things and they will flag things wrongly. Moderation is a best-effort function, not a guarantee.

You may stop using the service and delete your account at any time.

6. No warranty

Light Catchers is provided "as is" and "as available", without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the service will be uninterrupted, secure, error-free, or free from loss of data. We do not warrant that any defect will be corrected.

7. Backups and data loss

Keep your own copies of anything you care about. We make reasonable efforts to keep the service running and your data intact, and we provide an export tool so you can retrieve your content at any time. But we do not guarantee against data loss, and we are not a backup service. Do not rely on Light Catchers as the only place a photograph exists.

Similarly, our data removal is best effort as described in the Privacy Policy. We will do our best to give you the tools to remove your data; we cannot guarantee erasure of copies beyond our control.

8. Limitation of liability

To the fullest extent permitted by law, Light Catchers and its operators, contributors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or content, arising out of or relating to your use of or inability to use the service — regardless of the theory of liability and even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the service will not exceed one hundred US dollars (US $100.00), or the amount you paid us in the twelve months preceding the claim, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Light Catchers and its operators, contributors, and affiliates from and against any claims, demands, liabilities, damages, losses, costs, and expenses — including reasonable legal fees — arising out of or relating to:

  • your use of the service;
  • the content you upload, post, or share;
  • your violation of these terms;
  • your violation of any law or of the rights of any third party.

10. Your responsibility

Use the platform responsibly and protect yourself. Think carefully before making a photo public. Be mindful of what appears in your photographs — faces, house numbers, school names, identifying details. Do not photograph and publish other people without their permission. You are in the best position to judge what is safe for you to share, and that judgement is ultimately yours to make.

11. Changes to these terms

We may revise these terms from time to time. When we do, we will update the date at the top of this page. Continuing to use Light Catchers after a change means you accept the revised terms.

12. Governing law

These terms are governed by the laws of the United States and of the state in which the service is operated, without regard to conflict of law principles. Any dispute will be brought exclusively in the courts located there, and you consent to their jurisdiction.

13. Miscellaneous

If any provision of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between you and us regarding the service.
